Mediation in New York Divorce
Divorce mediation in New York is a voluntary, non-adversarial, dispute resolution option available to divorcing, divorced or unmarried partners who are in a dispute that requires a legal resolution. Through a structured process the couple is helped to reach a self-determined and reasonable agreement by a trained neutral third party: a mediator, who may be a New York divorce attorney trained in this field.

In divorce mediation, a neutral facilitator will help you and your spouse discuss needs and wants. The goal is to reach a mutually acceptable agreement without going to trial.

Mediation is usually less expensive than litigation in New York courts. It is preferred by judges, more satisfactory to the parties and fosters higher compliance.

In general, women are not as satisfied with mediated divorce settlements than are men. This is especially true in marriages where women hold less of the money and power.Mediation requires a sensitive mediator, reasonable spouses good faith negotiation and financial disclosure.

The ultimate purpose of the mediation is to resolve the financial and/or child-related disputes related to a divorce. Divorce mediation in New York is not the same as marriage counseling. However, the process of mediation can also provide great therapeutic benefit for both spouses.
