Divorce Litigation

Court House

In her more than 35 years as a practicing divorce attorney, Ingrid Gherman's talent as a keen courtroom litigator has been appreciated by both clients and adversaries. She has litigated cases in all New York City area courts which hear family law matters.

In most cases, a divorce settlement can be achieved without the intervention of the court, by some form of negotiation, mediation or collaborative means. When spouses are unable to come to an agreement, their case is then presented to the court.

The Supreme Court has the power to decide issues of divorce, property division, maintenance, support and custody. After the court hears evidence of the specific facts of the case, it will decide these issues based upon statutes of the NY Domestic Relations Law and precedent cases.

Conventional courtroom resolution of marital issues

Traditional dispute resolution is the option that most people know about. Each person hires a lawyer to handle the divorce. Whether a person is negotiating a settlement or presenting a case to the court, he or she needs a knowledgeable and experienced divorce lawyer to get the benefit of all the law has to offer. The attorney represents one spouse in the traditional attorney-client relationship that may involve litigation or result in a negotiated settlement. Litigation in court is costly from the financial and emotional perspective. However, certain family matters can only be resolved through litigation.

Complex Court Cases Involving the Equitable Distribution of Marital Assets

The laws governing equitable distribution of marital property are complicated, dynamic and constantly changing. Before agreeing to a property settlement or before asking the court to divide property, it is very important to conduct financial disclosure to determine how and when specific property and all other assets were acquired, so that marital assets can be defined and equitably distributed between both spouses.

Ingrid Gherman will help to guide you through the maze of the laws and disclosure devices which may affect the client's financial rights, obligations and the distribution of marital assets.

Only After All Attempt at Amicable Resolution are Exhausted

Even though Ingrid Gherman is considered a top matrimonial trial lawyer, she will recommend litigation as an option only after all effort have been exhausted to resolve the case peacefully and with fairness and dignity through options such as such as mediation, negotiation or collaborative law.

Attorney’s Fee in NY Matrimonial Cases

New York Domestic Relations Law permits the Courts to award counsel fees to enable a spouse to carry on an action or defend against an action, based on the circumstances of the case. The determination is addressed to the discretion of the Court.

On an application for attorney fees, the Court must consider the difficulty of the legal issues involved; the skill required handling the problem; the time and labor required; the lawyers' ability and reputation; the customary fee charged by the Bar for similar services; and the amount involved. The Court should also consider the relative assets of the spouses. Attorney fees may be awarded for services rendered prior to the commencement of the action.

If you believe that you will have to go to court to resolve your matrimonial case, Ingrid Gherman is the trial attorney to have in your corner. Call her law office at schedule a consultation at (212) 941-0767 or send the convenient on-line form.
